TERMS AND CONDITIONS

ISABEL & CO. FURNITURE COLLECTION & BESPOKE ORDERS
PLEASE TAKE THE TIME TO READ THE IMPORTANT INFORMATION BELOW

1. DEFINITIONS

In these Terms and Conditions:

  • "Customer" refers to any individual or entity purchasing goods from Isabel Lankester Limited.
  • "Goods" means any furniture, furnishings, or related items sold by Isabel Lankester Limited.
  • "Bespoke Items" are those items made to the Customer's specific requirements or design specifications.
  • "DAP/DDU" refers to "Delivered at Place/Delivered Duty Unpaid," meaning the buyer is responsible for any import duties, taxes, or customs fees in their country.
  • "Force Majeure" includes unforeseen events beyond Isabel Lankester Limited's control, such as civil unrest, natural disasters, pandemics, and government-imposed restrictions.

2. GENERAL TERMS & CONDITIONS

The following terms apply to all Isabel & Co. customers and do not affect your statutory rights. These conditions govern all sales by Isabel Lankester Limited to the exclusion of any conflicting terms set by the buyer, and no other representations, warranties, or agreements shall apply unless confirmed in writing.

3. ORDERS & PAYMENT

  • Quotations: Quotes are valid for 30 days and are subject to change thereafter. All quotes are provided with VAT and other relevant charges. Availability of Goods at the time of quoting is not guaranteed.
  • Customs Duties: For overseas Customers, all Goods are delivered under DAP/DDU terms. The Customer is responsible for any import duties, VAT, local taxes, and customs clearance fees required for delivery in their country. Isabel Lankester Limited is not liable for customs delays, and any such delays do not entitle the Customer to a refund.
  • Order Confirmation: Review your invoice carefully as Goods will be supplied based on the invoice details. A full payment confirms your order and initiates production of the Isabel & Co. collection.
  • Right to Cancel

Non-Bespoke Orders: Customers may cancel non-bespoke orders at any time before delivery for a full refund.

Bespoke Orders: Bespoke orders may be canceled within 48 hours of ordering without charge. After 48 hours, a 50% cancellation fee applies.

Made-to-Order and Bespoke Finish Items: Items that are made-to-order or require a bespoke finish may be canceled within 4 weeks of ordering. After 4 weeks, a 30% cancellation fee applies.

  • Order Cancellation by Isabel Lankester Limited: We reserve the right to cancel orders in cases of payment issues, errors in pricing, or where items are unavailable or cannot be delivered to the specified location. In such cases, any payments made will be refunded, but we will not be liable for other costs incurred by the Customer.

4. LEAD TIMES

Lead times are estimated based on availability and receipt of payment:

  • In-Stock Items: Typically dispatched within 7–10 working days.
  • Out-of-Stock Items: Lead times will be provided upon request, and delivery times are estimated only.
  • Bespoke Items: Lead times depend on material availability and workshop hours. Refer to your quotation for an estimate, as lead times may vary.

5. FINISH REPRESENTATION

Due to natural materials and hand-applied finishes, variations in color, texture, and appearance are inherent and not considered defects. Photos on our website and printed materials are intended as general representations and may vary due to screen and print quality. Samples of bespoke items are available upon request after a deposit is paid. Measurements are approximate and may vary slightly.

6. DELIVERY

  • General Delivery Information: Delivery dates provided are estimates. Orders may arrive before or after the estimated delivery date. Time is not of the essence for delivery, and Isabel Lankester Limited is not liable for delays outside our control.
  • Delivery Address: It is the Customer’s responsibility to ensure accurate delivery information. Isabel Lankester Limited is not liable for loss or damage once Goods have been delivered in line with the Customer’s instructions.
  • Risk and Ownership: The Customer assumes ownership of Goods once they have been delivered, at which point they are held at the Customer’s own risk.
  • Special Delivery Requests: Any special delivery conditions or access requirements (e.g., stairs, narrow hallways) should be disclosed at the time of order. Additional charges may apply.
  • Delivery within the UK Mainland: Delivery fees vary based on location and order size. If fitting or additional services (e.g., handling additional floors or stairs) are required, please request a custom delivery quote.
  • Delivery Outside the UK Mainland: Overseas delivery is available upon request. Unless otherwise stated, delivery is curbside only and does not include unpacking, assembly, or packaging disposal. A white-glove service, including unpacking and installation, is available for certain locations and incurs additional costs. Customs clearance, import duty, and local VAT are the Customer’s responsibility.
  • Failed Deliveries: If a delivery attempt fails due to the Customer’s unavailability or error, the full rate for redelivery will apply.
  • Excusable Delays (Force Majeure): Isabel Lankester Limited is not liable for delays resulting from force majeure events, including but not limited to war, civil unrest, natural disasters, pandemics, or port congestion.

7. RETURNS

  • Made-to-Order Items: Bespoke and custom orders are non-returnable. Cancellations for bespoke items are allowed within 48 hours of placing the order; a 50% cancellation fee applies after this window.
  • Collection Items: Non-customized items may be returned within 14 days of purchase with a valid receipt. Items must be in "as new" condition, and return shipping is at the Customer’s expense.
  • Consumer Contracts Regulations Compliance: We adhere to the Consumer Contracts Regulations (2014). Customers must notify us within 14 days of delivery to initiate a return, with returns completed within 14 days of notification. Items must be returned in uninstalled, unused, and resaleable condition.

8. CLAIMS

  • Damage and Shortages: Notify Isabel Lankester Limited of any in-transit damage or shortages within 7 days of delivery. After 7 days, Goods are considered accepted as delivered.
  • Faulty Goods: Claims for faulty products must be made in writing, with proof of purchase. Isabel Lankester Limited may request photographic evidence and/or return of Goods for inspection. Claims on items purchased through a retailer should be directed to that retailer.

9. DISPUTES

These Terms and Conditions are governed by the laws of England. Any disputes will be subject to the exclusive jurisdiction of the courts of England. Where possible, we encourage alternative dispute resolution before escalation.

10. MODIFICATIONS TO TERMS AND CONDITIONS

Isabel Lankester Limited reserves the right to update these Terms and Conditions without prior notice. Updated terms apply immediately and supersede any previously published terms. Orders placed before any changes remain governed by the terms in place at the time of purchase.

11. INTELLECTUAL PROPERTY AND DESIGN RIGHTS

All designs, drawings, and other creative content produced by Isabel Lankester Limited, including those made for bespoke orders, are the exclusive property of Isabel Lankester Limited. Isabel Lankester Limited retains all intellectual property rights in these designs and drawings, which may not be copied, reproduced, or used without prior written consent. Isabel Lankester Limited also reserves the right to incorporate any bespoke design created for a Customer into the Isabel & Co. main collection or other offerings.
